Setterwalls has advised Intersport Sverige AB in the appeal regarding early termination of lease contracts at Malmö Entré.
Intersport rented premises in the Malmö Entré shopping center. The owner of the shopping center carried out extensive renovation work on public areas to increase the attractiveness of the shopping center. One particular issue was whether the tenant had the right to terminate the lease in advance even though there was no disturbances in Intersport's rented store premises. The Supreme Court found that the disturbances in surrounding parts were so extensive that Intersport had the right to terminate the lease agreement and that it was the tenant's benefit from the premises that would take precedence in the assessment.
