Area of expertise
Compliance & Investigations
Setterwalls’ Compliance & Investigations group provides high-level expertise with a particular focus on compliance, business ethics, and sustainability. In a world where the demands for long-term sustainable business practices are constantly increasing, and where both laws and expectations from authorities, customers, and suppliers are becoming increasingly complex, it is critical for companies to act correctly – both in terms of legislation and their own operational goals and values.
Our dedicated Compliance & Investigations specialist team assists clients in identifying, managing, and preventing operational risks in relevant compliance areas such as corruption, competition law, export control, as well as selected areas within sustainability such as human rights and business ethics. With our extensive practical experience and pragmatic approach, we offer advice that combines legal expertise with commercial benefits and organisational maturity. Our goal is to tailor our advice to our clients’ specific business needs. In summary, we act as a strategic partner on the journey towards more sustainable and ethical business operations.
Our services
Our specialists in compliance & investigations offer expertise in several areas, including:
- Development and implementation of compliance programs: We help clients build, implement, and manage effective compliance programs that mitigate operational risks and promote long-term sustainable business practices. By carefully analyzing each company’s unique needs, conditions, and risks, we develop programs that are both effective and practically feasible.
- Risk assessments: We conduct risk assessments to help clients identify potential risks within their operations, including compliance risks arising from business models, corruption risks, and ESG risks. We also assist with risk management.
- Whistleblowing: We assist in the establishment of whistleblowing channels, internal company guidelines, information to whistleblowers, and various types of governance documents to ensure that the whistleblowing system is managed in accordance with the requirements of the Whistleblowing Act. We also act as an external recipient in whistleblowing channels and assist with internal investigations.
- Internal investigations: We have extensive experience in conducting independent internal investigations in cases of suspected misconduct, such as bribery and corruption, conflicts of interest, fraud, workplace issues, and harassment. We help our clients with both investigations and managing the consequences, as well as identifying the need for changes in work methods and structures.
- Competition law: We assist clients in all types of competition law matters. This includes competition law investigations, assessments of supply and distribution arrangements, collaborations between competitors, and long-term preventive work.
- Specialized advice: Our specialists have deep knowledge and experience in all areas that can pose a threat to commercial operations. From anti-corruption and competition issues to money laundering, sanctions, export control, whistleblowing, and behavioral problems such as harassment and discrimination. We offer specialized advice in these critical areas to ensure that clients comply with applicable laws and regulations and can act proactively to minimize risks.
- Sustainability in the value chain: We help clients conduct “ESG due diligence,” including “human rights due diligence,” and map the value chain to ensure sustainable business operations and compliance with new EU regulations, such as the Corporate Social Due Diligence Directive (CS3D), the Deforestation Regulation, and the EU Regulation on Forced Labor.
