Setterwalls successfully represented Jollyroom in a dispute over unfair marketing

The Patent and Market Court approved Jollyroom’s claim regarding an injunction under penalty of a fine for unfair marketing against Lekmer.

Setterwalls has represented Jollyroom, one of the Nordic region’s largest e-retailer in children’s and baby products, in yet another dispute over unfair marketing. This time against the main competitor Lekmer. Jollyroom brought an action regarding prohibitory injunction under penalty of a fine for a great number of marketing claims used by Lekmer, all of which made Lekmers’s prices and offers appear more favorable than they really were. After nearly two years of litigation, the Patent and Market Court issued judgement on November 6, 2020. Jollyroom’s case was upheld on all counts in all significant parts, and Lekmer was prohibited under penalty of a fine of 1,5 MSEK for using the marketing claims.
